WASIAT WAJIBAH SEBAGAI WUJUD PENYELESAIAN PERKARA WARIS BEDA AGAMA DALAM PERKEMBANGAN SOSIAL MASYARAKAT

Keluarga adalah lingkungan pertama dari setiap individu dalam perkembangannnya hingga dewasa. Oleh sebab itu, keluarga menjadi faktor penting dalam setiap hidup manusia. Dengan demikian, sangatlah penting untuk menjaga keutuhan dan keharmonisan suatu keluarga agar tidak terpecah karena masalah pembagian warisan. Putusan Kasasi Mahkamah Agung yang telah menjadi yurisprudensi dalam pemberian wasiat wajibah bagi anggota keluarga yang non muslim menjadi pedoman hakim dalam memutus perkara waris beda agama. Wasiat wajibah menjadi salah satu jalan dalam mendamaikan suatu keluarga yang berselisih paham soal pembagian warisan. Ijtihad hakim dalam putusannya untuk memberikan wasiat wajibah ini mencerminkan keadilan, kemanfaatan, dan kepastian hukum bagi para pencari keadilan. Dalam perkembangannya perlu suatu kejelasan yang rinci mengenai bagaimana teknis dan kriteria untuk dapat diberikan wasiat wajibah. Sehingga, wasiat wajibah ini bisa mencerminkan Islam sebagai rahmatan lil’alamin tidak hanya bagi muslim tetapi juga bagi penganut agama dan kepercayaan lain.

Family is the first environment that develop each individual to be mature person. Therefore,  family becomes an important factor in every human life. Thus, it is important to maintain the unity and harmony of a family. Do not let a family split because of  inheritance matter. Cassation decision of Supreme Court has became jurisprudence for inheritance matter of non moslem heirs. That jurisprudence is used to guide the judges for deciding the inheritance case of non moslem heirs. Wasiat wajibah be one solution for reconciling a family disputing about the division of inheritance. Judges decision to give wasiat wajibah reflecting fairness, usefulness, and legal certainty for those seeking justice. In its development, wasiat wajibah  needs for a detailed clarity on how technical and criteria to be granted. Thus, it was could reflect Islam as rahmatan lil'alamin not only for moslems but also for adherents of other religions and beliefs.
